Our Day in Court
First court date was Jan. 30, 2006 at the Haralson county courthouse in
Buchanan, GA. At 9:30 a.m.
We had a good turn out of friends and family for support (our cheering
section) the opposition consisted of Mr. Eidson, Officers Pate, Chief of Police
Scot Worthy, former Mayor Bagwell, and witness Ms. Morgan and Mr. Eidson's
lawyer Mr. Rego.
We were told to wait as we were going to be the second case heard so we
went into the common lobby area to wait our turn. Everyone was in great
spirits and we all laughed and joked and talked of many things.
When our case was called we all went in and found our places, taking
Festavus with us (the mannequin for those of you who didn't know we named
him) and placed him with me at the prosecutions table :o) The judge called
the lawyers into her chambers and we were left on our own to speculate as to
what was going on. When they all emerged we were to find the judge in a
quandary over the legal aspects of the case. She could hear the case if it
consisted of just issuing an arrest for Philip Eidson City Manager, but if she
found she needed to issue the arrest of the mayor or the police officers or
chief her hands would be tied as she didn't have the power to deal with these
individuals, being a magistrate judge she didn't have power over these people.
She postponed the hearing to either get permission and power from the
superior court (or superior court judge) to hear the case and make arrests or
to have the superior court take over and hear the case.
We are now awaiting that decision from the courts. It looks to me as if the
former mayor is ready to take the blame for issuing the order to illegally
remove the decoration from my home.
If so, in my view, this constitutes a conspiracy to have the police officers break
their oath of office by breaking the law and this now nets the City manager,
the former mayor, the police chief as he has also taken blame for sending the
officers to remove my property illegally. I am glad all the guilty parties have
come forward and said they are to blame. I am sure they will all say this was
justified but what they did was illegal and we will be sure to point that out in
court.
I have hired a Lawyer "Kurt Thomas"; of Carrollton to make sure my side is
represented in this matter. Even though I have done nothing wrong and this
criminal act was perpetrated against me this fight is at my own expense. I want
justice to be done not just for myself but for this city.
We have let this sort of thing go on way too long. It is time for a change. Our
town has not had good management for many years, the infrastructure is in
terrible shape, the unemployment rates and drop out rates are sky high, all
this stems from the no growth, no change mentality of the people who have
been in charge. When a town doesn't change and grow it stagnates, our
children can't live and work here they must go other place to make a living.
The methamphetamine epidemic is another symptom of a town that is slowly
dying from lack of care and attention. We can not support new businesses so
they close as soon as their leases are up. Our town is circling the drain and
we need to do something now.
We have a new city counsel and a new mayor and we need to find out if they
are up to the job. I have been totally unaware and unconcerned about the
leaders of our city until this was pushed upon me. I know a lot more now. I will
head a movement to enact change to Tallapoosa so our city can grow and
thrive. I will appreciate all the help I can get.
We need qualified people to come forward and offer their expertise in these
matters. I can not do Mr. Eidson's job I have not the education or the
experience to do so, but someone out there can do so. We need people for
the jobs and voices that can be heard in the City council meetings and people
to stand up and want change.
I will be hosting events at my building (2190 US Hwy 78) in downtown
Tallapoosa to hear you voices. I will place an ad in the paper and on here as
to the dates and times.

for our children and grandchildren so they can live here and thrive.
